Current Committee: Senate Rules Law Section: Penal Law Laws Affected: Amd §265.01-e, Pen L Versions Introduced in 2023-2024 Legislative Session: S5987
Exempts retired peace officers from the crime of criminal possession of a firearm, rifle or shotgun in a sensitive location.
BILL NUMBER: S9507 SPONSOR: MATTERA TITLE OF BILL: An act to amend the penal law, in relation to exempting retired peace officers from the crime of criminal possession of a firearm, rifle or shotgun in a sensitive location PURPOSE: To add retired peace officers to the exempt list of those who can continue to carry their legal firearms in sensitive locations. SUMMARY: Section 1 subdivision 3 of section 265.01-e of penal law is amended to add new paragraph (d-1) to read as followed: persons who were employed as a peace officers as designated by section 2.10 of the criminal proce- dure law but are retired.
JUSTIFICATION: When rushed gun legislation was hastily pushed through at the end of June, 2022, there was no input from law enforcement and other experts in the field. Without the benefit of their insight, a number of retired well-trained and qualified individuals were stripped of their Second Amendment rights. These Peace Officers, who include Court Officers, Parole Officers, Park Rangers and Correction Officers, are important members of the law enforcement family and should have been provided the respect they have earned. These hardworking men and women deserve the same rights in retirement that the rest of their law enforcement family have been given and this bill will rectify the oversight from the previ- ously adopted legislation. PRIOR LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: None EFFECTIVE DATE: This act shall take effect on the same date and in the same manner as section 4 of the chapter 371 of the laws of 2022, take effect.
